In some cases the inevitable cannot be avoided: your own debts, or those of your debtor, get out of hand to the point where a bankruptcy petition becomes the next step, either for your own business or for that of someone else.

In that case, only the party filing for the bankruptcy of their debtor pays a court registry fee. Anyone who files for their own bankruptcy does not have to pay a court registry fee. You also do not pay court registry fees if you defend against a bankruptcy petition that has been filed against you.

How much court registry fee do you pay when filing for someone else's bankruptcy?

The costs for filing for someone else's bankruptcy have been set for 2025 and are:

  • Legal entities (non-natural persons): € 714
  • Natural persons: € 331
  • Natural persons on a low income (low-income earners): € 90

The court registry fee must be paid to the court within four weeks of submitting the petition. If it is paid too late, the court may decide not to handle the case.

When do you not owe a court registry fee?

You do not owe a court registry fee in two situations:

  • When you file for your own bankruptcy.
  • When you defend against a bankruptcy petition that has been filed against you by someone else.
